What We Do
Three disciplines. One standard: win.
Devereaux, Prembix & Mills litigates at the intersection of complexity and consequence. Our practice spans class action, appellate, and commercial litigation — each handled with the same uncompromising preparation.
01
Class Action Litigation
We prosecute and defend the cases that define industries.
Class action litigation demands a rare combination of skills: the ability to manage sprawling discovery, command complex expert testimony, and persuade courts on certification issues that can make or break a case before trial begins. Our attorneys have done all of it — repeatedly, at the highest level.
We represent plaintiffs and defendants in securities fraud class actions, consumer protection matters, antitrust cases, and mass tort litigation. Our experience spans both sides of the docket, which means we understand exactly how opposing counsel will move — and we prepare accordingly.
Certification is where most class actions are won or lost. Our attorneys have briefed and argued certification motions in federal courts across the country, developing the evidentiary record and legal arguments that courts rely on when deciding whether a case proceeds as a class.
When cases go to trial — and ours do — we bring the same precision to the courtroom that we bring to every brief. Our trial record in class action matters speaks for itself.
Case Highlights
- Securities fraud class actions prosecuted and defended
- Consumer protection matters across 30+ states
- Antitrust class actions in multiple federal circuits
- Mass tort coordination and bellwether trial strategy
02
Appellate Litigation
We write briefs that move courts. We argue cases that set precedent.
Appellate litigation is a different discipline than trial work — and most firms treat it as an afterthought. We do not. Our appellate practice is built on the conviction that the best appellate work begins before the trial court rules, not after.
Our attorneys have argued before the United States Supreme Court, every federal circuit court of appeals, and numerous state supreme courts. We handle both direct appeals and cross-appeals, interlocutory appeals, mandamus petitions, and certiorari proceedings.
We are frequently retained by other firms to handle appeals in cases they tried. That trust reflects the reputation we have built: for clear, precise writing, for identifying the arguments that courts actually find persuasive, and for oral advocacy that holds up under the hardest questions from the bench.
We also advise trial counsel on preserving appellate issues — because the best appellate brief cannot save a record that was not properly made below. Our involvement at the trial level, even in a consulting capacity, has changed outcomes.
Case Highlights
- Arguments before the United States Supreme Court
- All 13 federal circuits
- Retained by outside firms for high-stakes appeals
- Interlocutory appeals and mandamus practice
03
Commercial Litigation
Complex disputes require counsel that will not flinch.
Commercial litigation encompasses some of the most consequential disputes in business: contract breaches that threaten company survival, corporate governance battles that determine who controls an enterprise, and fraud claims that can reshape entire industries.
We represent corporations, institutional investors, private equity funds, and high-net-worth individuals in disputes where the stakes are too high to leave to generalists. Our commercial litigation practice covers breach of contract, business fraud, fiduciary duty claims, partnership and LLC disputes, and complex insurance coverage matters.
We do not manage cases toward settlement. We prepare every matter as if it will be tried — because that preparation is what produces favorable settlements when they come, and favorable verdicts when they do not.
Our clients include companies that have been defrauded by business partners, executives facing derivative suits, and investors whose rights have been violated. In each case, our approach is the same: understand the facts better than anyone else in the room, and use that understanding to win.
Case Highlights
- Breach of contract and business fraud
- Corporate governance and fiduciary duty
- Partnership, LLC, and shareholder disputes
- Complex insurance coverage litigation
